Medical Negligence - Guidelines to be followed

The Hon'ble Supreme Court of India has issued, in the case of Kusum Sharma v. Batra Hospital & Medical Research Centre (decided on 10-02-10), guidelines to be followed while deciding a case of medical negligence.

Medical negligence occurs when a medical provider fails to exercise the kind of care and prudence that other providers in the same field of medicine provide. Medical negligence can occur in the form of recklessness, inattentiveness, or an omission.
